{"id":1146,"date":"2026-04-24T11:54:39","date_gmt":"2026-04-24T11:54:39","guid":{"rendered":"https:\/\/ibsdebtrecovery.ro\/?p=1146"},"modified":"2026-05-25T09:52:10","modified_gmt":"2026-05-25T09:52:10","slug":"new-rules-for-online-merchants-regarding-the-right-of-withdrawal","status":"publish","type":"post","link":"https:\/\/ibsdebtrecovery.ro\/en\/new-rules-for-online-merchants-regarding-the-right-of-withdrawal\/","title":{"rendered":"NEW RULES FOR ONLINE MERCHANTS REGARDING THE RIGHT OF WITHDRAWAL"},"content":{"rendered":"<p class=\"wp-block-paragraph\">Starting June 19, 2026, new legal obligations will come into force for online stores and platforms that conclude distance contracts with consumers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to Emergency Ordinance No. 18\/2026, online merchants will be required to implement within their website or application interface a dedicated online function that allows consumers to exercise their right of withdrawal from the contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Failure to comply with these obligations may result in sanctions imposed by the National Authority for Consumer Protection (ANPC), consisting of fines ranging from 5,000 lei to 15,000 lei.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What does the new obligation entail?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consumers must be able to submit their withdrawal request directly online, through a function that is easily accessible and clearly identifiable within the platform. It must be labeled with an explicit wording such as:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWithdraw from the contract here\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">or a similar, unambiguous message.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In practice, what needs to be implemented?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new rules require more than simply adding a button or link. In most cases, a complete technical flow will be necessary, enabling the proper handling and processing of withdrawal requests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We recommend that online platforms consider implementing the following elements:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a visible button or link on the website \/ customer account<\/li>\n\n\n\n<li>a dedicated online withdrawal request form<\/li>\n\n\n\n<li>identification of the relevant order<\/li>\n\n\n\n<li>automatic transmission of the request to the merchant<\/li>\n\n\n\n<li>confirmation of receipt sent to the customer<\/li>\n\n\n\n<li>integration with internal return and refund processes<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Which documents need to be updated?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, the new requirements impose a revision of the legal documentation displayed on the website, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Terms and Conditions<\/li>\n\n\n\n<li>Return \/ Withdrawal Policy<\/li>\n\n\n\n<li>Refund Policy<\/li>\n\n\n\n<li>any internal procedures regarding online orders<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Implementation may require both legal and technical adjustments, especially for custom-built stores or marketplace platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For this reason, we recommend starting the compliance process early in order to avoid operational disruptions or the risk of sanctions after June 19, 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this regard, we can assist you with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>legal audit of your website and existing documentation<\/li>\n\n\n\n<li>updating the Terms and Conditions<\/li>\n\n\n\n<li>drafting the withdrawal policy<\/li>\n\n\n\n<li>concrete recommendations for technical implementation<\/li>\n\n\n\n<li>final compliance check before the deadline<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If you would like a tailored assessment for your store or platform, please contact us for a focused discussion.<\/p>","protected":false},"excerpt":{"rendered":"<p>Incep\u00e2nd cu 19 iunie 2026, intr\u0103 \u00een vigoare noi obliga\u021bii legale pentru magazinele online \u0219i platformele care \u00eencheie contracte la distan\u021b\u0103 cu consumatorii.
